Paternal Rights Before Childbirth


Paternal rights before childbirth entitle the father-to-be to certain legal rights. For instance, if the mother is planning to give the baby up for adoption after its birth, you have the right to decide whether the baby can be adopted. If you agree with the adoption, you also have a say in whether the baby will be adopted by outsiders or family members.

In addition, paternal rights before childbirth also allow you to take physical custody of the child after birth if the mother gives up her parental rights to the child. Then you will be responsible for bringing up the child. However, asserting your paternal rights is extremely time sensitive and you would have to act fast in order to be named the father of the child on the birth certificate.

For you to gain your paternal rights before childbirth, you first have to acknowledge the paternity of the baby. This can be done by filling up certain forms for Putative Father Registry. However, you should know that not all the states in America have putative father registry. The states that do not have this procedure have a time limit after the birth of the child during which the father has to declare the relationship with the child. Therefore, you should check with your state the procedure to claim your paternal rights.

Besides this, paternal rights before childbirth also allow you be with the mother when she goes for medical examinations before the birth. In most cases, you will be asked to pay the hospital bills but this would be the right time for you to begin bonding with the baby while it is in the fetus. However, paternal rights before childbirth do not allow you to take time off from work to accompany the mother-to-be to hospital. You will either have to take leave or leave-without-pay should you want to be around for each consultation.
